Introduction

EION Management Sdn. Bhd., and EION Academy, a division of EION Management, (together “EION”, also “we”, “us”, and “our”) highly respects the privacy and confidentiality of the personal data of our clients, dealers, business associates, community members and others whom EION interact with:

    1. through our websites https://eionmanagement.com/ (EION Management) and https://www.eionacademy.com/ (EION Academy) (“Site”); and
    2. when offering our offline and online communities, for example, training programmes, webinars, and other relevant services (together the “Services”).

Purpose

EION has developed this to help you understand why and how EION collects, uses, discloses, processes, protects, and retains your personal data.

This Data Protection Notice lets you know your rights and how the data protection principles protect you as outlined in the Personal Data Protection Act (PDPA) 2010 of Malaysia, and the EU General Data Protection Regulation (GDPR).

Who We Are

    1. EION Management Sdn. Bhd. is a global gold investment management company and the proprietary of EION4U System, which is an automated profit tracking system. EION Management is an authorized mandate partner of Quantum Metal Sdn. Bhd. (QM) with the main purpose of assisting clients to invest in gold via the QM’s platform.
    2. EION Academy is a division of EION Management that operates, maintains, and updates the e-learning programmes of EION Management; and administers and manages the accounts of the subscribers.
    3. Quantum Metal Sdn. Bhd., our principal, is a gold bullion distributor registered in Malaysia providing 99.99% premium gold products sourced from The Perth Mint Australia.

Types of Personal Data EION Collects About You

Personal data refers to any information that can uniquely identify an individual person (a) on its own, or (b) when combined with other information. Under the PDPA, business contact information, (e.g. full name, business address, business telephone number) is not considered personal data so long as it is used for business-to-business (B2B) transactions.

Courses you’ve ordered and taken with us – traditional or online; gold investment account number as our investor; the number of units of investment; withdrawals; and additional investments

Facebook (FB) profile data when you logged in to EION Academy including profile name, the email address linked to your FB account, FB profile photo, public timeline feeds; username and password used when accessing our services and apps

Technical Information

browser; operating system (OS); internet protocol (IP) address; user agent; pages visited while using our online services and apps

Financial Information

bank account details (for employers, associates, contractors; and non-individual accounts)

When you conduct business with us or subscribe to our offerings, you are, in effect, agreeing to our terms and conditions, including our Privacy Policy; hence, entering into an agreement or contract with us. 

EION collects your data, under the terms of our contract with you, to process your subscription to our online offerings and/or investment to Quantum Metal products via our website or app. When you refuse to provide the data we request from you, we may have to cancel the processing of the products or your subscription with us as we will not be able to perform the contract we have or are trying to enter into with you.

How EION Collects Your Personal Data

EION collects your personal data:

    1. When you subscribe as a client of the EION community or interact with our services and app;
    2. When you visit or connect with us through our EION websites, EION webinars, and through our social media platforms;
    3. When you enquire, register, or enrol in any of the training courses and programmes (including our online e-learning courses);
    4. When you respond to our electronic direct mails (EDMs) sent by us as part of our marketing or promotion campaigns through an authorized third party EDM service provider;
    5. When you are referred to us for and/or services by one of our clients;
    6. When you enter into an agreement or contract with us to provide you with our services and information;
    7. When you register for a gold investment account through our online sites and use the relevant services;
    8. When you submit your CV and job application form (via email, in response to our recruitment advertisements, and via a job portal);
    9. When you sign a contract to join our company as an employee, contract or associate;
    10. When you send us feedback or respond to our survey questionnaires.

Who EION Discloses Your Personal Data To

EION discloses some of the personal data you provide us to the following entities or organisations outside EION to fulfill our services to you:

    1. Internal, External, and/or overseas Certification Authorities and educational institutions;
    2. External professional service providers;
    3. EDM/Email Service Vendors;
    4. Cloud Service Providers; and
    5. Government Agencies.

Where required to do so by law, EION may disclose personal data about you to the relevant authorities or to law enforcement agencies.

How EION Uses Your Personal Data

EION uses the personal data you provide us for one or more of the following purposes:

    1. Maintain your EION account;
    2. Analyse your visits to our EION websites, social media platforms, and EION services;
    3. Conduct training courses and proposed certification programmes (including our online e-learning training programmes) that you have signed up for and/or purchased;
    4. Conduct direct marketing and lead generation activities through analysing and tracking our sales proposals, advertisements, and EDMs at our events, conferences, seminars, and workshops;
    5. Conduct joint marketing with other companies and service providers;
    6. Communicate with customers, members, and EION website visitors (including when you leave a comment on our EION websites);
    7. Be featured in any of our testimonials or interviews on our online site;
    8. Respond to your inquiries and feedback to improve our quality of service;
    9. Analyse the use of our products, services, or online site;
    10. Process account payables/receivables; refunds; upgrades; etc;
    11. Process job applications, recruitment, and selection at EION;
    12. Carry out our obligations arising from any contracts entered between you and EION;
    13. Comply with or fulfill legal obligations and regulatory requirements.

How EION Manages the Collection, Use, and Disclosure of Your Personal Data

Obtaining Consent

Upon disclosing your personal data, EION shall consider that you have read and fully understood the statement, PDPA, GDPR, and all other corresponding information from EION to notify you of the purpose why EION is doing so on either your implied or expressed consent, directly or indirectly. EION does intend to collect personal data more than what is necessary for the stated purpose. EION shall seek fresh consent from you if the original purpose for the collection, use, or disclosure of your personal data has changed.

EION, under certain circumstances, may assume deemed consent from you when you voluntarily provide your personal data for the stated purpose, e.g. when you apply for a job with us using our job application forms.

EION may rely on exceptions to the need for consent under the PDPA for the collection, use, or disclosure of your personal data under the following circumstances (only those relevant to EION are included):

    1. Your personal data is publicly available;
    2. Your personal data is disclosed by a public agency or disclosed to a public agency;
    3. Your personal data is necessary for any investigation or proceedings;
    4. Your personal data is necessary for evaluative purposes (e.g. determining the suitability of a job applicant for the job applied for);
    5. Your personal data is necessary for the purpose of managing or terminating an employment relationship;
    6. Your personal data is necessary for a business asset transaction.

Withdrawal of Consent and Record Deletion

You may withdraw consent and/or request the deletion of your data with us by sending us reasonable advance notice.

EION will advise you of the likely consequences of your withdrawal of consent or record deletion request, e.g. without your personal contact information EION may not be able to maintain existing or current services as subscribed to by you of future services offered by us.

Your request for withdrawal of consent can take the form of an email or letter to us via our site support page (see section 9). Note that the processing lead time may take within and we may not always be able to comply with your request of record deletion for specific legal reasons which you will be notified of.

Data Retention

EION keeps track of the retention schedules of the personal data you provide us, in paper or electronic forms. EION will not retain any of your personal data when it is no longer needed for any business or legal purposes.

EION will dispose of or destroy such documents containing your personal data in a proper and secure manner when the retention limit is reached .

Ensuring the Accuracy of Your Personal Data

EION will take reasonable steps to ensure that the personal data EION collects about you is accurate, complete, not misleading, and up to date.

From time to time, EION may do a data verification exercise for you to update us on any changes to the personal data EION holds about you. If EION is in an ongoing relationship with you, it is important that you update us of any changes to your personal data (such as a change in your mailing address).

Protecting Your Personal Data

EION has put in place reasonable and appropriate organisational measures to maintain the confidentiality and integrity of your personal data and will only share your data with authorised persons on a ‘need to know’ basis.

Access and Corrections to Your Personal Data

You may write to us to find out how EION has been using or disclosing your personal data for as long as your data is kept with EION. Before EION accedes to your request, EION may need to verify your identity by checking your NRIC or other legal identification documents. EION will respond to your request as soon as possible, or within 30 days from the date EION receives your request. If EION is unable to do so within 30 days, EION will let you know and give you an estimate of how much longer EION requires. EION may also charge you a reasonable fee for the cost involved in processing your access request.

If you find that the personal data EION holds about you is inaccurate, incomplete, misleading or not up to date, you may ask us to correct the data. Where EION is satisfied on reasonable grounds that a correction should be made, EION will correct the data as soon as possible, or within 30 days from the date EION receives your request.

Transfer of Personal Data

Where there is a need to transfer your personal data to another country outside Malaysia, EION will ensure that the standard of data protection in the recipient country is comparable to that of Malaysia’s PDPA. If this is not so, EION will enter into a contractual agreement with the receiving party to accord similar levels of data protection as those in Malaysia.

Use of Cookies

EION uses “cookies” to collect information about your online activity on our EION website. A cookie is a small text file created by the EION website that is stored on your computer to provide a way for the EION to recognize and keep track of your preferences. The cookie makes it convenient for you to not have to retype the same information again when you revisit the EION website or in filling out electronic forms.

Most EION cookies used are “session cookies”, which will be deleted automatically from the hard disk of your computer at the end of the session.

You may choose not to accept cookies by turning off this feature in the browser. Note that by doing so, you may not be able to use some of the features and functions in our EION online/website applications.

Third-Party Consent

EION does not get consent on behalf of other individuals. EION only receives consent from the individual who will be dealing directly with EION.

EION treats such queries and feedback seriously and will deal with them confidentially and within a reasonable time.

Changes to this Privacy Policy

EION may update this Privacy Policy from time to time. EION will notify you of any changes by posting the latest Notice on our EION website. Please visit our EION website periodically to note any changes.

Changes to this Notice take effect when they are posted on our EION website.
