Introduction

At EION Management Sdn. Bhd. (“EION”) EION highly respect the privacy and confidentiality of the personal data of all our Clients, dealers, business associates, community members and others whom EION interact with in the course of providing our offline and online community, training programmes and other relevant services.

EION have developed this Data Protection Notice to assist you in understanding how EION collect, use, disclose, process, protect and retain your personal data that is in our possession.

How EION Collect Your Personal Data

The personal data refers to any information that can uniquely identify an individual person (a) on its own, or (b) when combined with other information. Under the PDPA, business contact information (e.g. full name, business address, business telephone number) is not considered as personal data so long as it is used strictly for business-to-business (B2B) transactions.

EION collect your personal data :

  1. When you sign up as a client of the EION community or interact with our services;
  2. When you visit or connect with us through our EION websites, EION webinars and through social media platforms;
  3. When you enquire, register or enroll in any of the training courses and certification programmes (including our online e-learning courses);
  4. When you respond to our electronic direct mails (EDMs) sent by us as part of our marketing or promotion campaigns through an authorized third party EDM service provider;
  5. When you are referred to us for our training programmes and/or services by one of our clients;
  6. When you enter into an agreement or contract with us to provide you with our services and information;
  7. When you register for an Gold Investment account through our online sites and use the relevant services;
  8. When you submit your CV and job application form (via email, in response to our recruitment advertisements and via a job portal,)
  9. When you sign a contract to join our company as an employees, contract or associate

Types of Personal Data EION Collect About You

The types of personal data EION collect about you include:

  1. Your contact information (Name, Address, Phone No., Email Address);
  2. Your personal details (Name, Email Address, Password);
  3. Your personal and professional details contained in your curriculum vitae when you apply to us for a job;
  4. Your courses taken with us (traditional or online)
  5. Your IP addresses and pages visited while using our online services
  6. Your bank account details (for employers, associates, contractors)

How EION Use Your Personal Data

EION use the personal data you provide us for one or more of the following purposes:

  1. Maintain your EION account;
  2. Analyze your visits to our EION websites, social media platforms, and EION service
  3. Conduct training courses and proposed certification programmes (including our online e-learning training programmes) that you have signed up for and/or purchased;
  4. Conduct direct marketing and lead generation activities through analyzing and tracking of our sales proposals, advertisements and EDMs on our events, conferences, seminars and workshops;
  5. Conduct joint marketing with other companies and service providers;
  6. Communicate with customers, members and EION website visitors (including when you leave a comment on our EION websites)
  7. Be featured in any of our testimonials or interviews on our online site;
  8. Respond to your inquiries and feedback to improve our quality of service;
  9. Analyze the use of our products, services or online site;
  10. Process account payables/receivables;
  11. Process job applications, recruitment and selection at EION;
  12. Carry out our obligations arising from any contracts entered into between you and EION;
  13. Comply with or fulfil legal obligations and regulatory requirements.

Who EION Disclose Your Personal Data To

EION disclose some of the personal data you provide us to the following entities or organisations outside EION in order to fulfil our services to you:

  1. Internal, External and/or overseas Certification Authorities and educational institutions;
  2. External professional service providers;
  3. EDM/Email Service Vendors;
  4. Cloud Service Providers;
  5. Government Agencies.

Where required to do so by law, EION may disclose personal data about you to the relevant authorities or to law enforcement agencies.

How EION Manage the Collection, Use and Disclosure of Your Personal Data

Obtaining Consent

Upon you disclosing your personal data, EION shall consider that you have read and fully understood the Privacy policy statement, PDPA and all other corresponding information from EION to notify you of the purpose why EION are doing so on either your implied or expressed consent directly or indirectly. EION does intend to collect personal data more than is necessary for the stated purpose. EION will seek fresh consent from you if the original purpose for the collection, use or disclosure of your personal data has changed.

EION under certain circumstances may assume deemed consent from you when you voluntarily provide your personal data for the stated purpose, e.g. when you apply for a job with us using our job application forms.

EION may rely on exceptions to the need for consent under the PDPA for the collection, use or disclosure of your personal data under the following circumstances (only those relevant to EION are included):

  1. Your personal data is publicly available;
  2. Your personal data is disclosed by a public agency or disclosed to a public agency;
  3. Your personal data is necessary for any investigation or proceedings;
  4. Your personal data is necessary for evaluative purposes (e.g. determining the suitability of a job applicant for the job applied for);
  5. Your personal data is necessary for the purpose of managing or terminating an employment relationship;
  6. Your personal data is necessary for a business asset transaction;

Withdrawal of Consent

If you wish to withdraw consent, you should give us reasonable advance notice. EION will advise you of the likely consequences of your withdrawal of consent, e.g. without your personal contact information EION may not be able to inform you of future services offered by us.

Your request for withdrawal of consent can take the form of an email or letter to us in our online service/website.

Use of Cookies

EION use “cookies” to collect information about your online activity on our EION website. A cookie is a small text file created by the EION website that is stored in your computer to provide a way for the EION to recognize and keep track of your preferences. The cookie makes it convenient for you to not have to retype the same information again when you revisit the EION website or in filling electronic forms.

Most EION cookies use are “session cookies”, which will be deleted automatically from the hard disk of your computer at the end of the session.

You may choose not to accept cookies by turning off this feature in browser. Note that by doing so, you may not be able to use some of the features and functions in our EION online/website applications.

Third-Party Consent

EION does not get consent on behalf of other individuals. EION only receives consent from the individual who will be dealing directly with EION.

How EION Ensure the Accuracy of Your Personal Data

EION will take reasonable steps to ensure that the personal data EION collect about you is accurate, complete, not misleading and kept up-to-date.

From time to time, EION may do a data verification exercise for you to update us on any changes to the personal data EION hold about you. If EION are in an ongoing relationship with you, it is important that you update us of any changes to your personal data (such as a change in your mailing address).

How EION Protects Your Personal Data

EION have put in place reasonable and appropriate organisational measures to maintain the confidentiality and integrity of your personal data, and will only share your data with authorised persons on a ‘need to know’ basis.

How EION Retain Your Personal Data

EION keeps track of the retention schedules of the personal data you provide us, in paper or electronic forms. EION will not retain any of your personal data when it is no longer needed for any business or legal purposes.

EION will dispose of or destroy such documents containing your personal data in a proper and secure manner when the retention limit is reached.

How You Can Access and Make Correction to Your Personal Data

You may write in to us to find out how EION have been using or disclosing your personal data over the past one year. Before EION accede to your request, EION may need to verify your identity by checking your NRIC or other legal identification document. EION will respond to your request as soon as possible, or within 30 days from the date EION receive your request. If EION are unable to do so within the 30 days, EION will let you know and give you an estimate of how much longer EION require. EION may also charge you a reasonable fee for the cost involved in processing your access request.

If you find that the personal data EION hold about you is inaccurate, incomplete, misleading or not up-to-date you may ask us to correct the data. Where EION are satisfied on reasonable grounds that a correction should be made, EION will correct the data as soon as possible, or within 30 days from the date EION receive your request.

Transfer of Personal Data

Where there is a need to transfer your personal data to another country outside Malaysia, EION will ensure that the standard of data protection in the recipient country is comparable to that of Malaysia’s PDPA. If this is not so, EION will enter into a contractual agreement with the receiving party to accord similar levels of data protection as those in Malaysia.

EION may update this Data Protection Notice from time to time. EION will notify you of any changes by posting the latest Notice on our EION website. Please visit our EION website periodically to note any changes.
